Subdividing a property

Do you wish to divide your building into apartment rights involving properties with a rent below the rent liberalisation threshold? In that case, pursuant to Article 22 of the Housing Act, you can apply for a subdivision licence from the municipality.

How does it work?

The municipality determines whether you are permitted to split your property, taking into account:

  • the distribution of housing within the municipality
  • the splitting of the property must not obstruct urban renewal
  • whether the property is suitable for subdivision

What to do?

  • You can apply for the “ licence ” at city hall.
  • Sometimes you also require an environmental licence, for example, if you are planning renovations.

  • a subdivision plan
  • a valuation report
