The municipality's right of first refusal

A right of first refusal means that the municipality has the first right to purchase a property. If you wish to sell your home, building, or land subject to a right of first refusal, you must first offer the property for sale to the municipality. The municipality then has the right of first refusal. Other government entities may also have a right of first refusal. 

What should I do?

  • Notify the municipality that you wish to sell your property. Be sure to include the cadastral designations and square footage.
  • The municipality must let you know within 6 weeks whether it intends to purchase the property. If the municipality does not respond within those 6 weeks, you may sell the property freely for up to 3 years thereafter.
  • If the municipality does not wish to purchase the property, you may sell it to someone else within 3 years of this decision.
  • If you reach an agreement with the municipality, you will sign a purchase agreement with the municipality.
