Public Notice of the Allotment of Municipal Land
For every issuance of immovable property by the municipality (sale of land, renting, establishment of building rights), DE municipality acts transparently, which is why DE municipality publishes all issuances. This allows you to make known that you wish (also) to be considered for concluding an agreement, as DE municipality strives for equal treatment. Nevertheless, DE municipality may also select a single suitable party. In that case, DE municipality sets out the reasons in the publication document.
You will find two types of publications below: a selection procedure for issuance or a one-on-one issuance. With these publications, DE municipality complies with the ruling of DE Supreme Court of November 26, 2021 (Didam judgment).
Response period
With a view to maintaining progress in these issuance processes and obtaining clarity regarding DE legal certainty of the transactions, DE municipality applies a response period of 20 calendar days following publication.
This period is a strict deadline. If you have not responded or initiated summary proceedings within the specified period of 20 calendar days, you will be deemed not to oppose DE aforementioned land issuance and you will be deemed to have waived your rights in this regard.
