Notice of default to the municipality for delayed decision-making
If you have submitted an application or objection and the municipality fails to make a decision on time, you can hold the municipality in default. This means you request the municipality to make a decision within 2 weeks. If the municipality fails to do so, it must pay you an amount. This amount is called a penalty payment.
How does it work?
- The municipality must make a decision on your application or objection within a statutory period. If no statutory period applies to your application or objection, a decision period of 8 weeks applies.
- If the municipality requires more time to make a decision, it may extend the period. The municipality must always send you a notification regarding this.
What to do?
Download the Notice of default form and print it out. Fill in all the details and send the form to the municipality.
How long does it take?
- Within 2 weeks of receiving your form, the municipality will make a decision on your application or objection.
- If the municipality fails to do so, it must pay you a penalty payment for every day after the deadline that it fails to make a decision.
- As a last resort, you can also take legal action. This is called 'lodging an appeal'. The court may order the municipality to make a decision within 2 weeks. The court may also determine a penalty payment if the municipality fails to make a decision within 2 weeks.
